Terms of Sale

CENTRAL COAST BICYCLES – TERMS OF SALE

By purchasing products from Central Coast Bicycles ("CCB," "we," "our," or "us"), you ("Customer," "you," or "your") agree to the following Terms of Sale.

 

1. Orders and Acceptance

All orders are subject to acceptance by Central Coast Bicycles. We reserve the right to refuse, cancel, or limit any order for any lawful reason, including product availability, pricing errors, suspected fraud, or other circumstances that prevent fulfillment. An order confirmation does not constitute acceptance of an order. Acceptance occurs when we begin processing, manufacturing, assembling, or shipping the order.

2. Product Information
We make every effort to accurately display product descriptions, specifications, colors, images, and pricing. Due to differences in monitors, photography, manufacturing processes, and component availability, actual products may vary slightly from those shown on our website.Specifications and components may be modified without notice when necessary due to availability, supplier changes, product improvements, or manufacturing requirements. Any material changes will be communicated to the customer when practical.

3. Pricing and Payment
All prices are listed in U.S. Dollars. Payment is due at the time of purchase unless alternative arrangements are approved in writing by Central Coast Bicycles. We reserve the right to correct pricing errors at any time. All sales are final.

4. Custom and Made-to-Order Products
Many Central Coast Bicycles products are custom-built, personalized, assembled to order, or manufactured specifically for the customer. By placing an order for a custom product, the customer acknowledges that production may begin shortly after the order is received and that materials may be purchased specifically for that order. Custom orders may not be canceled, returned, exchanged, or refunded once production, assembly, customization, or procurement of materials has begun, except as required by applicable law. Examples of custom products include, but are not limited to:

  • Custom bicycle frames

  • Complete bicycle builds

  • Personalized color selections

  • Special-order components

  • Products assembled to customer specifications


5. Production and Delivery Estimates
Any production, assembly, shipping, or delivery timeframe provided by Central Coast Bicycles is an estimate only and is not guaranteed unless expressly stated in writing. Actual delivery times may vary based on manufacturing schedules, supplier lead times, shipping conditions, customs processing, inspection requirements, weather events, and other factors beyond our control. Customers acknowledge that bicycles and bicycle components may require significant production, quality-control, inspection, assembly, and transit time before delivery.

6. Shipping and Risk of Loss
Customers are responsible for inspecting shipments upon arrival and promptly notifying both the carrier and Central Coast Bicycles of any visible shipping damage.

7. Force Majeure
Central Coast Bicycles shall not be liable for any delay, failure to perform, or inability to fulfill an order caused by events beyond our reasonable control, including but not limited to: Natural disasters and acts of God; Fire, flood, earthquake, severe weather, or other environmental events;Pandemic, epidemic, or public health emergencies; War, terrorism, civil unrest, or political instability;  Government actions, regulations, embargoes, or restrictions; Labor shortages, strikes, or work stoppages; Utility failures or infrastructure disruptions; Transportation interruptions; Port congestion; Customs inspections, holds, or delays; Supply chain disruptions; Material shortages; Manufacturing interruptions; Supplier delays or supplier insolvency; Shipping carrier delays; and Any other circumstance beyond our reasonable control. In the event of a force majeure event, delivery schedules shall be extended by a reasonable period corresponding to the delay.Central Coast Bicycles will make commercially reasonable efforts to communicate significant delays and continue performance as soon as reasonably possible. 

8. Warranty

Central Coast Bicycles warrants that products sold by us will be free from defects in materials and workmanship under normal use for the warranty period specified for the applicable product.This warranty does not cover: Normal wear and tear; Improper assembly or installation; Improper maintenance; Misuse or abuse; Racing, stunts, jumps, or competitive use beyond intended design; Crashes or accidents; Modifications performed by third parties; Cosmetic damage occurring after delivery. Warranty remedies are limited to repair, replacement, or refund at the sole discretion of Central Coast Bicycles.

9. Limitation of Liability
To the maximum extent permitted by law, Central Coast Bicycles shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of profits, loss of opportunity, personal injury, property damage, or business interruption arising from the purchase or use of our products.Our maximum liability shall not exceed the amount paid by the customer for the product giving rise to the claim.

10. Chargebacks and Payment Disputes
Customers agree to contact Central Coast Bicycles to attempt resolution of any order-related concern before initiating a credit card dispute or chargeback. Documentation including order confirmations, communications, customization requests, production records, shipping records, and acceptance of these Terms of Sale may be used to respond to payment disputes.

11. Governing Law
These Terms of Sale shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

12. Entire Agreement
These Terms of Sale, together with any policies referenced on our website, constitute the entire agreement between the customer and Central Coast Bicycles regarding the purchase of products through our website. By placing an order, the customer acknowledges that they have read, understood, and agreed to these Terms of Sale.
